Conservation Commission Minutes 09/06/06
FINAL

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chair, Pam Goff, Russell Maloney, Ray Kellman, Virginia Dyer, Rusty Walton, Conservation Officer and Chuck Hodgkinson.  Also attending were Ann Boyer and Chuck Wiley.  Absent were Bruce Bartels and David Flanders.    

Mr. Steves opening the meeting at 1:30 PM and announced the Commission would make a site visit to 18 Harbor Hill Road; AP 27.1-106.

GEORGE SOURATI FOR LABAREE CONTINUED PUBLIC HEARING NOI SE 12 – 503; AP 21-36:  Mr. Steves opened the continued public hearing at 2:00 PM and read a letter from the applicant requesting a continuance to October 18, 2006 @ 2:00 PM.  A motion to accept the request was made, seconded and unanimously approved.

HELEN PARKER PUBLIC MEETING RFD; AP 27.1-106:  Mr. Steves summarized the observations made during the site visit.  Ms. Parker asked if she might add the replacement of the roofs on all three structures to the Request for Determination of Applicability.  The Commission agreed this could be added to the application provided extra netting would be used to keep the debris from the roof and knee wall repairs from falling into the harbor.  The Commission added that the debris should be removed from the site on a daily basis.  With no further discussion a motion for a negative determination with these special conditions was made, seconded and unanimously approved.  
  
GLENN PROVOST FOR CHRIS WHITE CONTINUED PUBLIC HEARING NOI SE 12 – 519; AP 271-101:  Mr. Steves opened the continued public hearing at 2:15 PM and was informed that the applicant, Glenn Provost requests a continuance to September 20, 2006 @ 2:00 PM.  A motion to grant the continuance was made, seconded and unanimously approved.

CHUCK WILEY FOR HANK BELL REVISED NOI SE 12 – 474; AP 32-63.2:  Mr. Wiley explained his client’s request to plant an additional 5000 triple stem beach grass plants with jute erosion netting to further protect the coastal bank.  The original application and Order of Conditions approved planting 2500 of the same plants along the cliff face.  Mr. Steves read Mr. Wiley’s letter dated August 23, 2006 describing the work.  Mr. Wiley added that 4 inch staples will hold the jute netting in place and that these staples will corrode and ultimately rust away.  The only time for the planting would be now or early spring when the plants are dormant.  The new plantings will be spaced about one foot apart.

After a brief discussion the Commission agreed this is a good addition to the original plan.  A motion to approve the extension of work that has been performed to further protect the coastal bank was made, seconded and unanimously approved.  Chuck H. will send a letter to the DEP informing them of the approved changes to the original application and Order of Conditions.

CHRIS ALLEY FOR EDWARD MILLER RE-OPENED PUBLIC HEARING; NOI SE 12 – 520; AP 33-60:  Mr. Steves re-opened the public hearing at 2:30 PM.  He read a letter from the applicant requesting the application for a floating dock be withdrawn without prejudice.  A motion to accept the request was made, seconded and unanimously approved.

ANN BOYER DISCUSSION AP 19-16.4:  Ms. Boyer described how she would like to put an addition onto her house to expand her living room and add a laundry room.  The addition would be approximately 80 feet from the vernal pool on her neighbor’s property.  It will be over 100 feet from the pond.  After a brief discussion the Commission recommended that Ms. Boyer file a Request for Determination of Applicability and include a schematic drawing, a certified site plan, stake out the location of the addition for a future site visit and have the Conservation Officer certify the distances from the resource areas.

ADMINISTRATION:  Draft By-Law Regulation:  Chuck H. distributed a draft by-law regulation that addresses GL Ch. 44 Section 53G.  This regulation would allow the Commission to hire an outside consultant if deemed necessary and have the respective applicant pay for the cost.  After discussion a motion to accept the regulation as drafted pending final approval from town counsel was made, seconded and unanimously approved.

Dr. Ganz Emergency Certification; AP 4-25:  Mr. Walton summarized the circumstances behind Dr. Ganz’s need to file an Emergency Certification to repair the dam to his pond.  After discussion the Commission approved the emergency action provided the Conservation Officer observes the work being done and a formal Notice of Intent is filed in due time.

Hornblower property AP 33-118:  Chuck H. summarized the owner’s desire to determine if this 1.1-acre parcel is a buildable lot.  After discussion and a lack of specific plans the Commission determined that within its jurisdiction a structure might be built if it were more than 100 feet from Nashaquitsa Pond and was able to receive Board of Health approval for septic and water.  It was noted that approval might be needed from additional town boards.

MINUTES:  The meeting minutes for 8/16/06 were reviewed.  A motion to approve the minutes as presented was made, seconded and unanimously approved.  

SIGNATURES:  The required signatures and notary were performed on the Leavy septic upgrade Certificate of Compliance SE 12 – 369; AP 24-36.  The Parker negative Determination of Applicability was signed for AP 27.1-106.

With no further business to conduct the meeting adjourned at 3:02 PM.
